Terms of Service

Effective date: 1 June 2026

These Terms of Service ("Terms") govern your use of the Build Intel website (buildintel.com.au) and your purchase of any Site Risk Report ("Report") from Clearwater Consulting T/as Buildintel (ABN 60 662 312 217) ("Build Intel", "we", "us", "our"). By placing an order you confirm that you have read and agree to these Terms, our Refund Policy and our Privacy Policy, which together form the contract between you and us.

1. Our service

Build Intel prepares Site Risk Reports for residential properties in Western Australia. A Report is a desktop review: it brings together information about a property from government and other third-party datasets and presents it, together with our own indicative comparisons and risk ratings, in plain English. It covers matters such as bushfire, flood, groundwater, ground conditions, noise, coastal erosion, corrosion, climate and wind classifications, planned development, utility locations, and benchmarks of build cost, size and duration.

2. Service area and coverage

We prepare Reports for residential properties in Western Australia only. If you supply an address outside Western Australia, or a property we cannot locate in the official cadastre, we will not prepare a Report and will refund you in accordance with our Refund Policy. Some datasets do not cover the whole State. Where a dataset has no coverage for your property, the relevant section of the Report will say so rather than give a rating.

3. What a Report is, and what it is not

3.1 A Report is general information. It is prepared without any site visit, inspection, survey, soil testing or consultation with local government, service authorities or other agencies. Ratings such as "low", "medium" and "high" are our general classifications for comparing sites and are not measurements, engineering assessments or statutory determinations.

3.2 A Report is not, and must not be treated as: a valuation or appraisal of land or property; a Bushfire Attack Level (BAL) assessment or bushfire management plan; a geotechnical, structural, engineering, hydrological, acoustic, heritage or environmental report; a contaminated-sites search or certificate; a title search, planning certificate or statement of approvals; a Before You Dig Australia enquiry or service location survey; a building inspection; or legal, financial, insurance or investment advice.

3.3 Build cost, size and duration figures in a Report are statistical benchmarks derived from Australian Bureau of Statistics data and our own calculations. They are indicative only, are not a cost plan, estimate or quotation, and may differ materially from the price and timeframe your builder offers.

3.4 Before acting on anything in a Report you must exercise your own skill and care, verify information that matters to your decision against original sources, and obtain independent professional advice appropriate to your circumstances. You should not decide to buy, sell, finance, design or build solely on the basis of a Report.

4. Data sources and currency

4.1 Reports are compiled from data made available by Commonwealth and Western Australian government agencies and other custodians, including the Western Australian Land Information Authority (Landgate), the Department of Water and Environmental Regulation, the Department of Fire and Emergency Services, the Department of Primary Industries and Regional Development, the Department of Energy, Mines, Industry Regulation and Safety, the Department of Transport, the Australian Bureau of Statistics and the Australian Building Codes Board, together with Build Intel's own calculations and classifications.

4.2 Each dataset is used under a licence granted by its custodian. We acknowledge each custodian, and state the currency of each dataset, on the "Important Information, Disclaimer and Acknowledgements" page of every Report. No custodian has been involved in preparing any Report, and no custodian endorses Build Intel or our Reports.

4.3 Datasets have their own dates, scales and methods of collection and are updated by their custodians from time to time. A Report reflects the data as it stood on the extraction date shown in the Report. We do not update Reports after delivery, and we do not warrant the accuracy, currency or completeness of third-party data.

4.4 If a third-party data service is unavailable, we may delay delivery of your Report until it is restored, or, if the outage is prolonged, refund your order.

5. Government location data – conditions you must accept

5.1 Reports contain location information (including property boundaries, addresses and topography) that Build Intel licenses from the Western Australian Land Information Authority (WALIA) trading as Landgate under a Value Added Reseller Licence. Landgate requires that every person who receives a Report first agrees to the conditions in this clause 5. By placing an order you agree to them, and you agree to make anyone you share a Report with aware of them.

5.2 Permitted use. You may use a Report only for your own personal or business purposes. You must not sell, licence, hire, publish or otherwise derive revenue from a Report or from any location information in it, other than by providing the Report, unaltered and in the same format, to a person to whom you are selling or supplying the property to which it relates.

5.3 Acknowledgements. You acknowledge that:

(a) the location information in a Report is derived from Landgate's location information data;

(b) WALIA owns the copyright in that data and all rights are reserved; other than as permitted by the Copyright Act 1968 (Cth), the data may not be reproduced or re-used without the prior written permission of Landgate;

(c) the location information is provided in good faith on an "as is" basis; Landgate gives no guarantee and accepts no liability, including for negligence, for any error or omission in it, and accepts no responsibility and disclaims all liability for any loss or damage arising from your use of or reliance on it;

(d) reliance may only be placed on original source documents, such as the certificate of title and survey plan, available from Landgate;

(e) you must exercise your own skill and care with respect to the location information and obtain professional advice before relying on it;

(f) areas and dimensions shown in or derived from the location information may be approximate values only, and you must refer to the official registered documents, survey plans, diagrams and other records available from Landgate; and

(g) the location information may be subject to privacy legislation and to contractual restrictions on publication, and Landgate takes no responsibility for any breach of them.

5.4 Audit. You consent to Build Intel collecting your name, the property address, the date of your order and the date the Report was supplied, and providing that information to Landgate if Landgate requires it for the purpose of auditing or inspecting Build Intel's compliance with its licence. Our Privacy Policy explains how we handle this information.

6. Your responsibilities

You are responsible for providing accurate and complete information, including selecting the correct property address from the list offered at checkout. We prepare the Report for the address you select. We are not responsible for a Report that is inaccurate or unsuitable because the information you provided was incorrect or incomplete, and a Report prepared for an incorrectly selected address is not refundable once delivered (see our Refund Policy).

7. Pricing and payment

Prices are shown on our website in Australian dollars. Build Intel is not registered for GST, so no GST is charged or included in the price and none will appear on your receipt. Payment is processed securely by our payment provider (Stripe). By purchasing, you authorise us, via Stripe, to charge your chosen payment method for the total amount shown at checkout.

8. Acceptance and delivery

8.1 We will not supply a Report until you have accepted these Terms (including clause 5), our Refund Policy and our Privacy Policy at checkout. Your acceptance is recorded against your order.

8.2 We deliver Reports by email to the address you give at checkout, as a PDF. Our delivery commitment is two business days from receipt of payment (business days are Monday to Friday, excluding Western Australian public holidays). If we do not deliver within that time you may cancel your order for a full refund, as set out in our Refund Policy. Where we expect a delay, for example because of a third-party data outage or exceptional demand, we will tell you before the deadline and offer you the choice of waiting or a refund.

9. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms. Nothing in the Refund Policy limits your rights under the Australian Consumer Law.

10. Intellectual property and permitted use

10.1 Build Intel owns all intellectual property rights in our website and in the text, ratings, comparisons, calculations and layout of each Report. Third-party data in a Report remains the property of its custodian, as acknowledged in the Report.

10.2 We grant you a non-exclusive, non-transferable licence to use your Report for your own personal or business purposes in connection with the property it concerns, subject to clause 5. You may give a copy to your professional advisers, builder, lender or insurer for that purpose.

10.3 You must not resell, republish, redistribute or otherwise commercially exploit a Report; remove, obscure or alter any copyright notice, acknowledgement, disclaimer or licence statement in it; or reproduce any map, figure or dataset from a Report separately from the Report itself.

10.4 Professional users. If you are a buyer's agent, settlement agent, mortgage broker, builder or other professional ordering a Report on behalf of a client, you may provide the complete, unaltered Report to that client for that client's own use in connection with the property, provided you make the client aware of these Terms and of clause 5. Any other on-supply requires our written permission.

11. No third-party reliance

A Report is prepared for the person who ordered it. Except as permitted by clauses 5.2 and 10, no other person may rely on a Report, and we accept no responsibility to anyone other than you.

12. Liability

12.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

12.2 Subject to clause 12.1, and to the extent permitted by law, we are not liable for any loss or damage arising from: your use of or reliance on a Report contrary to clause 3; any error, omission or lack of currency in third-party data; your provision of incorrect information; or any use of a Report by a person other than you.

12.3 Subject to clause 12.1, and to the extent permitted by law, we exclude liability for indirect or consequential loss, including loss of profit, loss of opportunity and loss arising from a decision to buy, sell, finance or build.

12.4 Where the law permits us to limit our liability for a failure to comply with a consumer guarantee (which is generally where a Report is acquired for business rather than personal, domestic or household purposes), our liability is limited, at our option, to supplying the Report again or refunding the fee you paid for it.

13. Complaints and corrections

If you believe any information in a Report is inaccurate, or you are dissatisfied with our service, please email info@buildintel.com.au with your order number and the details. We will acknowledge your complaint within two business days and aim to resolve it within ten business days. Where a Report contains an error caused by us, we will correct and re-issue it at no charge. If you are not satisfied with our response, you may contact Consumer Protection WA. Nothing in this clause limits your rights under the Australian Consumer Law.

14. Privacy

We handle personal information in accordance with our Privacy Policy, including the collection and disclosure described in clause 5.4.

15. Third-party tools

Our website uses third-party tools, including Google Maps for address search and Stripe for payments. Your use of those features may be subject to the relevant third party's terms.

16. Changes to these Terms

We may update these Terms from time to time. The version published on our website at the time you place an order applies to that order.

17. Governing law

These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
