Terms of Service

These Terms of Service ("Terms") govern your use of the BuildIntel website (buildintel.com.au) and your purchase of any report or service ("Report") from BuildIntel (Clearwater Consulting, ABN 60 662 312 217) ("BuildIntel", "we", "us", "our"). By using our website or purchasing a Report, you agree to these Terms.

1. Our service

BuildIntel prepares property due-diligence Reports for sites in Western Australia. A Report provides a general overview of potential building risks and attributes of a property (such as bushfire, flood, groundwater, noise, ground conditions, build cost benchmarking and indicative build timelines), compiled from third-party datasets and our own indicative models.

2. Service area

We provide Reports for properties in Western Australia only. If you provide an address outside Western Australia, or a property we cannot locate, we cannot prepare a Report (see our Refund Policy).

3. Reports are general information only

Reports are provided for general information purposes only. A Report:

  • is based on third-party data, generic or extrapolated data, and indicative models, and may not reflect site-specific or current conditions;

  • is not professional, legal, engineering, planning, financial or surveying advice;

  • is not a substitute for independent professional advice, site inspection, or formal assessments (such as a geotechnical, hydrogeological, bushfire (BAL), heritage or contamination assessment).

You should verify all information with the relevant authority and obtain appropriate professional advice before making any decision, including any decision to buy, sell or build.

4. Data sources

Reports incorporate data from third parties, including Australian and Western Australian government sources. We acknowledge those sources in our Reports. We do not warrant the accuracy, currency or completeness of third-party data, and those third parties are not responsible for our Reports or their conclusions.

5. Your responsibilities

You are responsible for providing accurate and complete information, including the correct property address. We are not responsible for a Report that is inaccurate or unsuitable because the information you provided was incorrect or incomplete.

6. Pricing and payment

Prices are shown on our website in Australian dollars (AUD) and include GST where applicable. Payment is processed securely by our payment provider (Stripe). By purchasing, you authorise us (via Stripe) to charge your chosen payment method for the total amount shown at checkout.

7. Delivery

We aim to deliver Reports within 48 hours of purchase. Delivery times are estimates only. Our commitments and your refund rights for late or undelivered Reports are set out in our Refund Policy.

8. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

9. Intellectual property and permitted use

We (or our licensors) own all intellectual property rights in our website and Reports. We grant you a non-exclusive licence to use your Report for your own personal or internal business purposes in relation to the property it concerns. You must not resell, republish, redistribute or commercially exploit a Report without our written permission.

10. Limitation of liability

To the maximum extent permitted by law, and subject to clause 11:

  • our Reports and website are provided "as is", and we exclude all warranties not expressly stated;

  • we are not liable for any loss or damage arising from your use of, or reliance on, a Report or our website, including indirect or consequential loss; and

  • our total liability to you in connection with a Report is limited to the amount you paid for that Report.

11. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under that law. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to re-supplying the service or paying the cost of re-supply.

12. Privacy

We handle personal information in accordance with our Privacy Policy.

13. Third-party tools

Our website uses third-party tools (for example, Google Maps for address search and Stripe for payments). Your use of those features may be subject to the relevant third party's terms.

14. Changes to these Terms

We may update these Terms from time to time. The version published on our website at the time of your purchase applies to that purchase.

15. Governing law

These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
