Privacy Policy

Clearwater Consulting T/as Buildintel (ABN 60 662 312 217) ("Build Intel", "we", "us", "our") respects your privacy and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what we collect, why we collect it, who we share it with and how you can contact us about it. It applies to our website (buildintel.com.au) and to the Site Risk Reports ("Reports") we prepare.

1. What personal information we collect

We may collect:

(a) Identity and contact details: your name, email address and, if you provide it, your phone number.

(b) Property and order details: the property address you select, the information you give us in the order form (such as your estimated build cost, building size and design type), and your order history.

(c) Payment information: the details of your purchase. Card payments are processed by Stripe; we never see or store your full card number.

(d) Communications: messages you send us, including enquiries, support requests and complaints.

(e) Website usage data: information collected automatically through cookies and similar technologies, such as your IP address, device and browser type, the pages you view, how you reached our site and how you interact with it (see section 7).

2. How we collect it

We collect personal information directly from you when you use our website, complete our order or contact forms, make a purchase or contact us. Our address search uses Google Maps Platform to suggest and validate Western Australian addresses as you type; your keystrokes in that field are sent to Google to return suggestions. Some information is collected automatically through cookies, pixels and analytics tools placed on our website by us and by the third parties named in section 7.

3. Why we use it

We use your personal information to:

(a) prepare and deliver your Report and provide our services;

(b) process payments and issue receipts;

(c) respond to your enquiries, complaints and requests for corrections;

(d) keep the register of Reports supplied that our data licence with Landgate requires (see section 5);

(e) operate, secure, maintain and improve our website and services;

(f) send you service communications about your order;

(g) measure the effectiveness of our advertising and, with your consent or where otherwise permitted by law, show you relevant advertising (see section 7); and

(h) meet our legal, tax, licensing and record-keeping obligations.

We will only send you marketing emails if you have opted in, and every marketing email will include a way to unsubscribe. We do not use your property address or Report contents for marketing.

4. Who we share it with

We do not sell your personal information. We may share it with:

(a) Service providers who help us run our business, each of which handles your information under its own privacy terms and only for the purpose we engage it: Squarespace (website hosting, e-commerce and order management), Stripe (payment processing), Google (Maps Platform address search, Google Workspace email, Google Analytics and Google Ads) and Meta Platforms (Meta Pixel, used for advertising measurement).

(b) The Western Australian Land Information Authority (Landgate), for audit purposes only, as described in section 5.

(c) Professional advisers, insurers and regulators where reasonably required.

(d) Any other person where you have consented, or where disclosure is required or permitted by law.

5. Landgate licence register and audit

Our Reports include location information (property boundaries, addresses and topography) that we license from the Western Australian Land Information Authority trading as Landgate. Our licence requires us to keep a register of every Report we supply, recording the customer's name, the property address, the date the customer accepted our Terms of Service, the date the Report was supplied and the Landgate products used, and to keep that register for seven years. Landgate may require us to produce the register so that it can audit or inspect our compliance with the licence. We disclose your information to Landgate only for that purpose, and Landgate handles it in accordance with its own privacy policy. By ordering a Report you consent to this collection and disclosure, as set out in clause 5.4 of our Terms of Service.

6. Overseas disclosure

Some of our service providers, including Squarespace, Stripe, Google and Meta, store or process data on servers outside Australia, including in the United States and Ireland. Where we disclose information overseas we take reasonable steps to ensure it is handled consistently with the APPs, including by using providers that are bound by their own privacy commitments and, where applicable, standard contractual terms.

7. Cookies, analytics and advertising

Our website uses cookies and similar technologies for three purposes.

Essential cookies, set by Squarespace and Stripe, make the site, shopping cart and checkout work. The site cannot function without them.

Analytics. We use Google Analytics 4 to understand how visitors find and use our site, for example which pages are read and where visitors leave the checkout. Google Analytics collects your IP address (which is truncated), device and browser information and your interactions with the site, and Google may combine this with other information it holds. You can opt out with the Google Analytics opt-out browser add-on (tools.google.com/dlpage/gaoptout).

Advertising measurement and remarketing. We use the Meta Pixel and Google Ads conversion tracking. These tools set cookies that record when you visit our site, view a product or complete a purchase, and they share that information with Meta Platforms and Google so that we can measure whether our advertising works and, where you have the relevant settings enabled in your Meta or Google account, show you advertisements for our services on their platforms. Meta and Google may also use this information for their own purposes under their privacy policies. You can control this through your Meta advertising preferences (facebook.com/adpreferences), your Google ad settings (adssettings.google.com) and the Your Online Choices site (youronlinechoices.com.au). You can also block or delete cookies through your browser settings; some features of the site may not work properly if you do.

We do not run advertising cookies on the checkout page beyond the conversion event that confirms a purchase, and we do not use the contents of your Report for advertising.

8. How we protect your information

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, including by using reputable third-party platforms with their own security measures, two-factor authentication on our business accounts and access limited to the people who need it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. How long we keep it

We keep the Landgate register described in section 5 for seven years after the Report is supplied. We keep order and payment records for the period required by Australian tax law (generally five years). We keep other personal information only for as long as it is needed for the purposes in this policy, after which we take reasonable steps to delete or de-identify it.

10. Accessing and correcting your information

You may ask for access to, or correction of, the personal information we hold about you by emailing info@buildintel.com.au. We will respond within a reasonable time, normally within 30 days, and may need to verify your identity first. If we decline a request we will tell you why.

11. Complaints

If you have a concern about how we have handled your personal information, please email info@buildintel.com.au with the details. We will acknowledge your complaint within five business days and aim to resolve it within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (oaic.gov.au, 1300 363 992).

12. Changes to this policy

We may update this policy from time to time. The current version is always available on our website, and material changes will be noted at the top of the page.
